The UK Spouse Visa is a route under Appendix FM of the UK Immigration Rules for the husband or wife of a qualifying partner who is in the UK or is returning to the UK. It may be used by Swiss citizens and by other nationals who are lawfully resident in Switzerland. Swiss nationality, EU/EFTA citizenship or a Swiss residence permit does not itself create a right to live in the UK, which is outside EU free movement and the Schengen area.

A successful UK Spouse Visa application from outside the UK is normally granted for up to 33 months. A person who continues to meet the requirements may extend their permission and, on the standard five-year route, may become eligible for indefinite leave to remain after 60 months.

2. Who Can Apply for a UK Spouse Visa?

You may apply to enter the UK as a spouse if you are aged 18 or over, are legally married to your partner, and intend to live together permanently in the UK. Your partner must have a qualifying status under Appendix FM.

For Switzerland-based applicants, citizenship and residence should be distinguished. A Swiss citizen living in Switzerland, an EU/EFTA citizen holding a Swiss permit and a third-country national lawfully resident in Switzerland may all potentially apply, but the appropriate application location, identity process and supporting evidence will depend on their circumstances.

3. Who Can Sponsor a UK Spouse Visa?

A qualifying partner may include a British or Irish citizen, a person settled in the UK, a person with specified limited leave under Appendix EU, a person falling within the relevant Turkish ECAA extension provisions, or a person with refugee permission or humanitarian protection. These definitions contain technical and transitional conditions.

A British citizen may return to the UK with the applicant. A person treated as present and settled may also, in specified circumstances, be admitted for settlement at the same time. Couples returning from Switzerland should plan carefully where they intend to live and how the sponsor will satisfy the financial requirement.

4. What Are the UK Spouse Visa Relationship Requirements?

Both spouses must be over 18 and must not be within a prohibited degree of relationship. They must have met in person, their marriage must be valid and recognised for UK immigration purposes, and the relationship must be genuine and subsisting. Any previous relationship must have broken down permanently, and the couple must intend to live together permanently in the UK.

The recognition of a marriage celebrated in Switzerland or another country can depend on the law of the place of celebration and the parties’ personal law. A marriage certificate is important but may not resolve every validity issue, particularly where there has been a proxy, customary, religious or previous marriage.

5. What Relationship Evidence Should Applicants Provide?

The Home Office assesses the relationship as a whole. Useful evidence may include marriage and civil-status records, records of living together, correspondence addressed to both spouses, travel history, communication records, shared financial commitments, evidence of children and practical plans for the couple’s life in the UK.

There is no universal document checklist that guarantees approval. Evidence should cover the history and present reality of the relationship without unnecessary or intrusive material. Documents not in English or Welsh normally require an appropriate translation.

6. UK Spouse Visa Financial Requirement

For a first partner-route application made on or after 11 April 2024, the standard minimum income requirement is normally £29,000 gross per year. Transitional provisions may preserve the previous threshold for certain applicants who entered the route before that date and are extending with the same partner.

Employment and Non-Employment Income

Permitted sources can include specified employment income, pension income and certain non-employment income. The relevant category determines the required period, calculation method and evidence.

Returning Sponsors and Swiss Employment Income

Swiss salary may be relevant, but overseas employment income is not treated identically in every category. A British sponsor returning from employment in Switzerland may need to show both qualifying overseas earnings and a qualifying UK job offer, depending on the category relied upon.

Evidence may include Swiss employment contracts, employer letters, payslips, bank statements, tax or social-insurance records. Appendix FM-SE prescribes the form and period of much of the evidence. Currency conversion is normally made using the exchange rate specified by the Rules or guidance at the relevant date.

Cash Savings

Cash savings are subject to a formula and detailed evidence requirements. Where savings alone are used to meet a £29,000 requirement, the usual required amount is £88,500. Savings normally need to have been held for at least six months unless a specified exception applies, such as funds derived from the recent sale of qualifying property or investments.

Self-Employment and Company Income

Specified self-employment or company income may be used, including income arising in Switzerland, but the relevant accounting period and documentary requirements are technical. Evidence may include company accounts, tax records, bank statements and other documents prescribed by Appendix FM-SE.

Adequate Maintenance

Different rules apply where the sponsor receives a specified disability or carer benefit. In those cases, the adequate-maintenance test may apply instead of the minimum income requirement.

7. Accommodation Requirement for a UK Spouse Visa

The couple must show that they will have adequate accommodation in the UK without recourse to public funds. The property must not be statutorily overcrowded and must not contravene public-health regulations.

Evidence may include a tenancy agreement, title documents, a letter from the owner or landlord and information about the property’s rooms and occupants. A property inspection report is not mandatory in every case but may assist where adequacy or overcrowding requires explanation.

8. UK Spouse Visa English Language Requirement

Unless exempt, an applicant making their first spouse application must normally demonstrate speaking and listening at CEFR level A1. An extension normally requires A2, while settlement usually requires B1 together with the Life in the UK Test.

The requirement may be met through nationality of a specified majority English-speaking country, an approved Secure English Language Test or an eligible degree taught in English. Exemptions include age 65 or over, a relevant physical or mental condition, and specified exceptional circumstances.

9. Applying for a UK Spouse Visa From Switzerland

A person lawfully resident in Switzerland will normally apply online from outside the UK and complete the prescribed identity and biometric process. The fact that a person holds a Swiss L, B, C or other residence permit does not amount to UK immigration permission, although it may help establish lawful residence in the country of application.

The application should address the validity, suitability, relationship, financial, accommodation and English-language requirements and include the specified supporting documents. The applicant should not travel to the UK intending to live there until entry clearance has been granted.

10. UK Spouse Visa Fees and Processing Times

As at 5 August 2026, the published Home Office application fee is £2,064 for an application made outside the UK and £1,407 for an application made inside the UK. The immigration health surcharge is additional: the published amount for an adult granted 33 months is £3,105. Fees can change and should be checked immediately before submission.

The Home Office states that an outside-UK partner application will usually be decided within 12 weeks. A standard in-country application meeting the financial and English-language requirements will usually be decided within eight weeks. Priority services may be available for an additional fee, but availability and service standards should be checked when applying.

11. Switching, Work and Settlement in the UK

A person with valid UK permission may be able to switch to the spouse route before their current permission expires. Visitors and persons granted permission for six months or less are generally excluded from the standard in-country route, subject to specified exceptions and human-rights provisions.

A spouse granted permission under the five-year route may work and study in the UK. Entry clearance is normally granted for up to 33 months and an extension for up to 30 months. After 60 months on the qualifying route, the applicant may apply for indefinite leave to remain if the relationship, financial, accommodation, English-language, Life in the UK and suitability requirements are met.

12. Refusals and Exceptional Circumstances

Where the Rules are not met, Appendix FM contains provisions requiring consideration of specified exceptional circumstances and Article 8 family-life issues. A grant outside the standard requirements may place the applicant on a 10-year route to settlement rather than the five-year route.

A refusal may carry a right of appeal where it refuses a human-rights claim. The decision notice must be checked carefully because the correct response may instead be a fresh application, correction request or judicial review, depending on the error and available remedy.
